In some situations, the vehicle might be transferred to another person who would require the name on the RC to be changed. The government has made the convenience of transferring ownership of the vehicle from one person to another. There is a fixed procedure to do so.
There are different situations under which the vehicle ownership could be transferred. Some of them are listed below:
Transfer of ownership when the vehicle is purchased by someone: In such a situation, the buyer's name should be added to the RC as the vehicle owner instead of the owner.
Transfer of ownership when the owner of the vehicle dies: In such a situation, the legal heir of the deceased owner must report to the RTO within 30 days of the vehicle owner's demise and their intention to be the owner of the vehicle. The legal heir may use the vehicle under the name of a deceased person for a maximum period of 3 months
Transfer of ownership of the vehicle sold in an auction: If a vehicle is bought in an auction, then the name of the new vehicle owner will show on the RC instead of the name of the old vehicle owner.
The procedure for transferring ownership is different for different circumstances:
In this case, you'll be required to fill up Form 29 and submit it to the RTO with the details of the transferer and the transferee.
The form must be submitted to the registering authority in the residential area of the transferee.
If the ownership transfer occurs within the same state, then the buyer must submit Form 30 within 14 days of the transfer along with the documents that must be submitted under Form 1.
If the ownership transfer is happening outside the state, then the buyer must submit Form 30 within 45 days of the transfer in addition to the documents which need to be submitted.
The buyer of the vehicle has to pay the charged that are levied for registering under Rule 81 of the Motor Vehicle Rules, 1989.
The new owner has to submit Form 31 to the registering authority.
The form for transfer of ownership must be submitted within three months.
The new owner of the vehicle must make the payment for the charges levied for the transfer of ownership by the registering authority.
If the vehicle has been purchased through a central or state government auction, then the transfer of ownership can be done by submitting Form 32.
The form should be submitted within 30 days of the purchase of the vehicle and the new owner must pay the charges levied on the purchase of the vehicle under Rule 81 of the Central Motor Vehicles Rules, 1989.
Documents required for the transfer of Ownership of the vehicle if it was purchased by someone:
Form 29
Form 30
Along with Form 29 and Form 30, Form 1 and 2 are also required.
The documents that need to be submitted under Form 1 and 2 are:
Form 1
Insurance Certificate of the vehicle
A certificate which verifies that the pollution is under control
Copy of PAN card of the vehicle owner
Imprint of chassis and engine pencil
Document that acts as the address proof of the vehicle owner:
RC Book of the vehicle
Undertaking of the buyer
Passport size photographs
A certificate that states that the taxes/challans levied on the vehicle has already been cleared.
Form 2
The owner must submit NOC which has been acquired from the financier.
If the vehicle owner hasn't received the NOC, then they must provide the proof for not having received the NOC by submitting the following documents:
A receipt from the concerned authority.
Receipt from the Post Office where the NOC Application has been submitted.
RC of the vehicle
Form 31
Insurance Certificate
Death Certificate of the previous owner.
Certificate which verifies that the pollution emitted by the vehicle is under control.
Copy of PAN card or Form 60/61 must be submitted.
Imprint of chassis and engine pencil of the vehicle.
Document that acts as a date of birth proof of the vehicle owner
Copy of a document that acts as the address proof of the vehicle owner.
RC Book of the vehicle.
Passport size photographs of the vehicle owner.
Document that shows the link between the deceased owner and the applicant
Signature identification of the individual who sold the vehicle.
Form 20 must be submitted by the individual as well. Form 20 contains the verification of the vehicle.
